Lawsuit Update: Preliminary Injunction Hearing Set for June 20th
The Hemp Industry Trade Association of Arizona (HITA) will return to court on Thursday, June 20th at 1:30 PM (PST) for a pivotal hearing on our motion for a Preliminary Injunction (PI). At this hearing, the judge is expected to issue a ruling that will determine whether Arizona’s hemp businesses can legally operate while our broader constitutional challenge moves forward.
This case is about more than regulatory overreach. It’s about defending the livelihoods of Arizona farmers, retailers, manufacturers, veterans, patients, and responsible adult consumers who rely on hemp-derived products for wellness, relief, and opportunity. The state’s enforcement crackdown has caused real harm—targeting businesses that operate under federal law and contribute millions to Arizona’s economy.

Why the PI Matters
A Preliminary Injunction (PI) functions similarly to the Temporary Restraining Order (TRO) we previously sought—but with greater weight and longer-lasting protection.
If granted, the PI would prohibit law enforcement from conducting raids or filing charges against lawful hemp businesses. This would allow retailers, wholesalers, and manufacturers in Arizona to resume legal operations while our lawsuit proceeds.
We are urging the Court to apply the PI to all hemp-derived products—including edibles, flower, and vapes—to fully reopen Arizona’s hemp market and protect all aspects of the industry.
What to Expect on June 20th
✅ Best-case scenario: The judge grants the PI for all hemp products—edibles, flower, and vapes.
➖ Most likely outcome: The PI is granted for inhalable products only, allowing sales of flower and vapes to resume.
❌ If denied: We are prepared to file an expedited appeal, likely to the Arizona Supreme Court, to continue the fight at the highest level.
